Items purchased by users through the WEBSITE may be collected in official LOREAK MENDIAN stores upon request. Otherwise, orders will be dispatched by courier to the address provided by the user. LOREAK MENDIAN accepts no liability for delays or non-delivery of products caused by an incorrect or incomplete delivery address provided by the customer.

Products will be delivered within the working hours of the courier company. Should the user not be at home when their order is delivered, they should contact the courier to agree a new delivery day and time. LOREAK MENDIAN accepts no liability for delays due to the user being absent at the time of delivery. To prevent these types of problems, we recommend that users provide a delivery address where they will be present to receive their order, and a phone number that the courier can contact to organise delivery as quickly as possible.

Delivery times may vary based on the delivery address and the time of purchase. Orders placed before 12:00 will leave our warehouse from 17:00 and may arrive the next day. Orders placed after 12:00 will leave our warehouse the next day.

Orders to be delivered throughout mainland Spain and the Balearic Islands will be received within three days. Orders to be delivered to other territories within the geographic scope will be received within a maximum of five days.

Delivery times are calculated based on working days and exclude weekends and national holidays in Spain, as well as local public holidays during which the LOREAK MENDIAN facilities are closed. The dates of these public holidays will be posted on the WEBSITE.

Orders may be delivered at any time between 08:00 and 20:00, Monday to Friday (except national holidays). The recipient must sign the acknowledgement of receipt or delivery note.

Users may check the status of their order by entering their order number on the WEBSITE.

For security reasons, LOREAK MENDIAN will not deliver orders to post office boxes and will not accept any orders where the recipient's identity and address cannot be identified.

The customer will become responsible for LOREAK MENDIAN items from the time of delivery.

Once the user receives the item that they ordered on the WEBSITE, they must verify that it corresponds to their order, that it is in perfect condition and that it has not been damaged in transit.

If the order received does not correspond to the one made by the user, they must inform LOREAK MENDIAN via the channels outlined under Faulty products in these General Terms and Conditions of Purchase. Any products delivered in error will be collected and the correct item dispatched, at no cost to the customer.

Prices are displayed in euros only. The final amount to be paid by the user, including Value Added Tax (VAT) and other applicable indirect taxes or duty, will be detailed in the product information.

Delivery is free if the user chooses to collect in store or the total order amount exceeds €150.00.

Delivery costs for shipping to addresses in the locations specified under Geographic scope will be indicated prior to completion of the order.

LOREAK MENDIAN reserves the right to modify the products sold on this website as well as item prices, shipping costs and other conditions or promotions, at any time and without prior notice. In any case, terms and conditions in force at the point of sale will be applied.

Promotional codes may be used in accordance with the terms and conditions of each one. Users may apply one discount to the purchase of one item, or one discount per order, during the period stated on the promotion.

Promotional codes may only be used on the WEBSITE.

The products sold through this website are subject to legally established guarantees such that LOREAK MENDIAN is liable for any nonconformities that occur within two years from delivery.

Pursuant to the provisions of the applicable legislation on consumers and users, products are considered to conform with the order where the requirements set out below are met, except where not applicable for any reason:

• The product matches the description and features specified on the website.
• The product is fit for the purposes for which products of the same type are normally used.
• The product is suitable for any special use requested to us by the customer when placing their order, provided we have confirmed that the product is suitable for said use.

a) Returns

The user has the right to withdraw from the contract by notifying the other contracting party within the period specified for the exercise of this right, without the need to justify their decision and without incurring a penalty of any nature. In short, the user has the right to return their order without providing justification.

The user will have 14 calendar days from receipt of their order to exercise their right to return the product they have purchased. The start date of this period will be the date recorded on the delivery note.

In accordance with the applicable legislation on consumers and users, the right to withdraw an order will not apply within the scope of our business under the following circumstances:

• The supply of goods manufactured in accordance with consumer and user specifications or which are clearly personalised.
• The supply of goods that may deteriorate or expire within a short time.
• The supply of sealed goods which may not be returned due to health or hygiene reasons and which have been opened following delivery.

The right to withdraw an order will entail no cost to the customer, including return shipping costs. All such costs will be borne directly by LOREAK MENDIAN.

Any customer wishing to exercise their right to withdraw an order should email info@loreakmendian.com indicating the number of the return note that they received with their order and the items they wish to return. They may use the template order withdrawal form provided in Appendix A of these General Terms and Conditions of Purchase, though this is optional.

LOREAK MENDIAN will send the user an email confirming receipt of their request and asking them to return the item in accordance with the section titled Returning items to LOREAK MENDIAN in these General Terms and Conditions of Purchase.

Following receipt of the product, LOREAK MENDAIN will examine the product to ensure it bears no defects caused by the customer before refunding the cost. The refund will be made within a maximum of 14 calendar days following the date on which the customer registered their return. LOREAK MENDIAN will bear the return shipping costs.

If (i) the returned product shows signs of damage or deterioration caused by the customer as a result of being handled in a way other than that necessary to establish its nature, features or how to use it, or (ii) the product is returned in an incomplete state, the customer will bear the cost of the reduction in value of the product. Under certain circumstances, this may mean that the amount paid for the item cannot be refunded. In such cases, the client will be notified by email and asked whether they wish to collect the item or have it returned to them, with postage payable on delivery, within a maximum of 15 calendar days. In any case, LOREAK MENDIAN accepts no liability for the safeguarding or storage of the item while it is on their premises.

b) Faulty products

If a product does not conform to the contract or has imperfections or defects, the user may request that the product be repaired or replaced, provided neither option is manifestly impossible or disproportionate. The user will incur no costs for the repair or replacement of the product, including shipping costs and, where applicable, costs for labour and materials.

If a product does not conform to the contract and/or has any imperfections or defects, the user should notify LOREAK MENDIAN as soon as possible by emailing info@loreakmendian.com, indicating the number of the return slip that they received with their order, the item(s) they wish to return and whether they would like it to be repaired or replaced.

LOREAK MENDIAN will reply to the user by email to ask them to return the item in accordance with the section titled Returning items to LOREAK MENDIAN in these General Terms and Conditions of Purchase.

Following receipt of the return by LOREAK MENDIAN, the returned item will be examined in detail and the user will be notified by email within a maximum of ten working days of whether or not the item will be repaired or replaced. In the case of repair or replacement, this will take place as soon as possible.

Where a repair or replacement is not possible, the user will have the right to cancel their order or to receive a discount on the price.

c) Exchanges and refunds

Without prejudice to the right to return an order and the provisions relating to faulty products which are detailed in sections a) and b) above, once an order has been formalised, no cancellation or modification of the order or any request for change or return on the part of the user will be accepted.

d) Returning items to LOREAK MENDIAN

Where the provisions of sections a), b) and c) above permit the return of a product to LOREAK MENDIAN, the customer should use the return form delivered to them with the product and should follow the instructions attached.

Said instructions will enable the customer to contact the shipping company assigned by LOREAK MENDIAN to request and arrange the collection day and time and formally return the product to LOREAK MENDIAN, at no cost to them.

In accordance with the applicable legislation, in the event of fraudulent use of a card to purchase an item, the customer and card holder may request the immediate cancellation of the charge. In this case, the corresponding credits and debits in the accounts of LOREAK MENDIAN and of the customer and card holder will be effected as soon as possible.

However, where a purchase has been made by the customer and card holder and a refund request is not a result of exercising their right to withdraw or terminate the contract, the customer will be liable for compensation to the company for any losses and damages caused as a result of the cancellation of the charge.
